He incautiously went under some overhanging batt which was known to be unsafe. Pensax-Fatal Accident to a Miner. An inquest was held at the New Inn on Tuesday before Mr S. P. Hughes Esq., Coroner, on the body of Emanuel Price, Age 19, - Miner. J.P. Barker Esq., Inspector of Mines for South Staffordshire and Worcestershire was in attendance. The first witness called was William Neath, of Abberley, a miner, who said deceased had been employed in the Pull (sic) House Colliery, Pensax, which belonged to James Moilliett Esq. On Monday week last, deceased was working in the pit within a few yards of witness. Whilst he was in the pit a clod of soil weighing six or seven hundred weight fell from the roof of the pit and struck deceased on the head, killing him almost immediately. Witness had been working at the same spot for three or four hours previously and he had not observed any signs of the slip. Deceased had been used to mining work since he was a Boy. Each man took care of himself, but if anyone saw danger in any part of the work he pointed it out to his neighbour. The distance of the place where the deceased was excavating from the mouth of the pit was sixty or seventy yards and the excavation was four feet wide and perhaps two yards long. The sides of the pit were timbered up. Cross-examined by Mr Baker: witness called himself a Charter Master. No one directed the men to their work Mr Barker: Do you know it is your duty to examine the works so that the men may run no danger? -Answer: Yes. Mr Barker: -Why did you go nine feet without timbering the pit?
Answer-We frequently go further than that.
Mr Barker then asked the witness whether he could give any reason why the clod fell. Witness said the clod fell accidentally. George Aston, Collier, was next called. He spoke to being at work with deceased, and in reply to Mr Barker said the pit was well timbered. Samuel Aston general manager of the mine, said the men took care of themselves. There were rules which the men were furnished with, if they asked for them. The jury returned a verdict of Accidental Death (From the Berrows Worcestershire Journal, Saturday August 20th 1864).
